Terms and Conditions of Trade for Arthur Jack & Co.

1. Contract

1.1 These Terms and Conditions of Trading (‘Agreement’) apply to all consumer contracts between Arthur Jack &Co and our subcontractors and you the Customer  in relation to all sales of goods and services.

1.2 Any order placed with us is not accepted until we have received full payment. Unless agreed otherwise by ourselves.

1.3 Any typographical, clerical or other error or omission in any sales literature, quotation, pricelist, acceptance of offer, invoice or other document issued by us will be subject to correction without any liability on our part.

2. Product Specifications

2.1 We have a policy of continuous Product development and reserve the right to amend the specification of Products without prior notice in relation to future sales.

2.2 Goods supplied may differ as a consequence from those on our website or advertised. Unless agreed with you, the Goods supplied will be of equivalent value, functionality and appearance.We will discuss with you any significant alteration in colour. Please see 3.3 below .

2.3 All products are hand finished  and accordingly they may not be uniform in colour or texture.

2.4 We will endeavour to match the colour of previous items purchased as accurately as possible, but variations in both the colour and texture may occur.

2.5 In order to help with drainage and to avoid overflowing, we suggest that clients don’t fill our planters more than 10CM (3″) below the top bar.

3. Measurements

The measurements of all our products will be as accurate as possible, but as they are artisanal may vary slightly from the measurements given. Please see the page relating to sizes and weights.

4. Prices

All prices are subject to change without notice. Please check our current prices when placing your order.

5. Payments

5.1 We require payment in full before despatch of Goods.

5.2 We will contact you as soon as possible to advise you of your estimated delivery date and at this time any balance will be payable. We  will then be able to confirm your actual delivery date.

6. Delivery

6.1 For all purchases we will get back to you with an estimated delivery date unless the planter(s) are in stock in which case you should receive your order within 3 working days.

6.2 We will deliver your order to any UK mainland address subject to a delivery charge(please see relevant web pages for current rates) We can deliver to foreign countries and Northern Ireland but delivery charges are subject to discussion. Please enquire.

6.3 If we accidentally damage items  in the course of delivery, then our liability for that damage is limited to the repair, refund or replacement of the item.

6.4 Time of delivery is not of the essence in this Agreement. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Arthur Jack & Co or delay due to any reasonable re-scheduling of delivery.

7. Returns and Refunds

7.1 If you change your mind, under distance selling regulations, then, subject to clause 7.2 you have a right to cancel your order up to 7 working days after delivery. This does not affect your statutory rights. To do this please contact us on 01299-827059 or e-mail to sales@arthurjack.co.uk. You will be required to send the item/s back at your own cost.

7.2 Items must be returned to us in a saleable condition and we reserve the right to make reasonable deductions from the amount refunded to you if there are signs of wear and/or damage to the item. Once we have received the item/s back into stock we can give you a full refund.

7.3 For planters shipped to countries outside the UK any returns would be subject to individual discussion.

7.4 If we agree on receipt of your returned item(s) that it(they) are indeed faulty we will give you a full refund including the cost of the return.

8. Finish

8.1 Finish on products may vary. Our planters are made by metal crafsmen in England All our finishes are applied using our own special process, and thus, unlike factory finishes, there can be slight variations between products. The most common variation is that of colour – though the actual variation is often almost negligible or very slight.

8.2 Whilst we guarantee to finish your order in the same batch, we cannot guarantee that subsequent orders will match your original order.

8.3 We cannot accept any responsibility for fading or discolouration, over time. The planters will weather differently outdoors and according to location. i.e items outside near the sea  will weather differently to items positioned in-land.

8.4 We cannot accept any responsibility for discolouration, due to exposure or contact with any chemicals sprayed nearby or applied directly.

8.5 We recommend that you wash you planters down with soap and water annually, to prevent build up of a normal green residue.

9. Data Protection

Arthur Jack & Co. conform to the  Data Protection Act 1998

10. Rights of Third Parties

For the purpose of the Contracts (Rights of Third Parties) Act 1999, this Agreement does not and is not intended to give any rights, or any right to enforce any of its provisions, to any person who is not a party to it.

11. Applicable Law

These Terms and Conditions of Trading are governed by and are to be construed in accordance with the laws of England and Wales
